Terms of service

  • Seller does not make any warranty, expressed or implied, with respect to products manufactured by others.  All such products are sold by Seller “as is, where is.”  To the extent you have purchased products manufactured by others, and a warranty has been extended with respect to the Products, Seller does not make or extend such warranty and your sole recourse is to the manufacturer of such Products.  Seller makes no other warranties or representations and hereby disclaims any such warranties or representations, expressed or implied, by operation of law otherwise, including, without limitation, any implied for warranty for merchant ability, fitness for a particular purpose or any other matter.  It is expressly understood and agreed that buyer’s exclusive remedy, and seller’s sole liability for any and all losses and damages to Buyer resulting from any cause whatsoever, including Seller’s negligence, alleged damaged or defective goods irrespective of whether such defects are discoverable or latent, shall in no event exceed the purchase price of the particular products with respect to which losses or damages are claimed or, at the election of the Seller, the repair or replacement of defective or damaged products. In no event, including in the case of a claim of negligence, shall Seller be liable for incidental or consequential damages.
  • By making this purchase, the Buyer hereby agrees that in the event of a claim against the Seller on account of the purchase this sale, shall be deemed to have occurred at the store of the Seller(listed on purchase invoice) from which the product was distributed to the Buyer, and the venue of any action brought shall be in the County in which that store is located.
  • Recommendations and advice by Seller for the use of Products are furnished gratuitously and are based upon information believed to be reliable.  Buyer’s use of or reliance upon shall be at Buyer’s risk.  Seller’s sole liability with respect to the sale of the products to Buyer and use of products by Buyer, and Seller concerning advice or assistance given to Buyer by Seller for a separate fee, shall be contained only in a separate written agreement.
  • No understanding promise or representation and no waiver, alteration or modification of the provisions hereof shall be binding on the Seller unless approved in writing by an authorized representative of the Seller’s owner.
  • Any names of contractors provided by Seller is done as a service only.  It does not in any way serve as a recommendation of any contractor.  We do not imply or assume any responsibility for workmanship or performance by others.
  • All paint and stains should be verified prior to application.  Seller assumes no responsibility once a product is applied.
  • Seller shall not be responsible for labor claims.

Color Considerations

  • Colors are a product of how our eyes see light reflected off surfaces. There are many factors that will affect how each person sees a color.
  • Color cards and chips are made in batches to match a standard. 
    These can vary batch to batch, as well as change over time due to light exposure.
    This can result in actual paint mixed varying slightly from the paper chip.
  • Paint is also made in batches, and can have slight variances in color.
  • The pigments (colorant) used to tint the base paint to a specific color can also have slight variances which can result in color differences.
  • The method used to apply a paint or stain can also affect how the color will look.
  • Despite the above considerations, the light source will have the biggest impact on how a color appears.
  • We have utilized an internal quality control system unique to Hoover Paint for over 50 years that helps us greatly reduce issues with colors not matching batch to batch.
  • Please note that on-screen and print color representation may vary from actual paint color.
  • While we will do our proven best to eliminate problems, it is the customer’s responsibility to check the color before applying the material.  We are happy to make any changes needed to get the color correct, however, we cannot be responsible after the material has been applied.

Wallcovering

  • Opened rolls of wallpaper may not be returned or exchanged.
  • We are not responsible for inaccurate measuring estimates. We strongly recommend having the installer provider Buyer with quantity to order.
  • Pattern repeat and match will factor into the amount of paper required.
  • Some unopened special-order wallcoverings may be returned within 25 days of purchase receipt date.
  • Manufacturers and Distributors may charge a 25% restocking fee plus shipping and handling on authorized returns and must be paid by Buyer.
  • Borders, fabric, commercial papers may not be returned.
  • Manufacturers’ terms listed in the sample books apply.
  • We will not be responsible for any labor claims.

Returns

  • All mixed products are Non-Returnable nor exchangeable.  Every color we sell is custom made just for you; therefore, cannot be returned or exchanged.  We strongly recommend if you are unsure about a color, purchase a sample and check it before starting your project.
  • Special order items are Non-Returnable nor exchangeable.  As a service to our customers, we have access to many different products from our suppliers that we do not stock. We are happy to special order items.  However, we are unable to return them to our suppliers; therefore, we are unable to provide a refund on these items.
  • Most stock items may be returned within 30 days if still in the new unopened package.
